بَابٌ في الشُّرْبِ وَقَوْلِ اللَّهِ تَعَالَى: {وَجَعَلْنَا مِنَ الْمَاءِ كُلَّ شَيْءٍ حَيٍّ أَفَلاَ يُؤْمِنُونَ}

The Statement of Allāh تعالى: “… And We have made from water every living thing. Will they not then believe.” (V.21:30)

بَابٌ في الشُّرْبِ، وَمَنْ رَأَى صَدَقَةَ الْمَاءِ وَهِبَتَهُ وَوَصِيَّتَهُ جَائِزَةً، مَقْسُومًا كَانَ أَوْ غَيْرَ مَقْسُومٍ

Giving water in charity, or as a gift, and whoever thinks that giving water in charity, or as a gift or by way of a testament is permissible, whether it is divided or not

باب مَنْ قَالَ إِنَّ صَاحِبَ الْمَاءِ أَحَقُّ بِالْمَاءِ حَتَّى يَرْوَى لِقَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لا يُمْنَعُ فَضْلُ الْمَاءِ

Whoever said, “The owner of the water has the right to drink till he is satisfied, as the Prophet (ﷺ) ﷺ said, ‘Superfluous water should not be withheld from others.’”

حَدَّثَنَا مُعَلَّى بْنُ أَسَدٍ، حَدَّثَنَا وُهَيْبٌ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنِ الزُّبَيْرِ بْنِ الْعَوَّامِ ـ رضى الله عنه ـ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ لأَنْ يَأْخُذَ أَحَدُكُمْ أَحْبُلاً، فَيَأْخُذَ حُزْمَةً مِنْ حَطَبٍ فَيَبِيعَ، فَيَكُفَّ اللَّهُ بِهِ وَجْهَهُ، خَيْرٌ مِنْ أَنْ يَسْأَلَ النَّاسَ أُعْطِيَ أَمْ مُنِعَ ‏"‏‏.‏

Narrated Abu Huraira: Allah's Messenger (ﷺ) said, "No doubt, you had better gather a bundle of wood and carry it on your back (and earn your living thereby) rather than ask somebody who may give you or not."
